2.3 Exclusion of Damages

In no event shall our total liability to you for all damages exceed the amount paid by you, if any, for accessing our services during the twelve months preceding the claim. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Virginia, United States, without regard to its conflict of law provisions. Your use of our services may also be subject to other local, state, national, or international laws.

3.2 Jurisdiction and Venue

Any legal action or proceeding arising under these Terms and Conditions shall be brought exclusively in the federal or state courts located in Loudoun County, Virginia, and you hereby consent to the personal jurisdiction and venue of such courts. You waive any objection to jurisdiction or venue in such courts.

3.3 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, the parties agree to first attempt to resolve the matter through good faith negotiations. If the dispute cannot be resolved through negotiation within thirty days, either party may pursue other available remedies.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our services must be filed within one year after such claim or cause of action arose or be forever barred.

You agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Stream Arcade.

Stream Arcade shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, labor disputes, power failures, internet disruptions, or governmental actions.

4.1 Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect and enforceable.

4.2 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and Stream Arcade concerning your use of our services and supersede all prior agreements and understandings.
